Legal Question in Landlord & Tenant Law in California
Tricky Landlord
Hi,
My Landlord pulled a fast one on my roommate and I,
he notified us that the house we are renting from him
was going to be sold, he assured us that we had plenty of time to move (about 3-4 Months) and that during those months we didn't have to pay rent so that we could save up for our next place....In which he also assured us that he would even go as far as helping us find a new place!
So the following week -he would show up several times un-announced with people showing them the house (he would just walk in) then the next thing you know -we get served eviction papers by the sheriffs Department, The Owner was not the Initiator- but by someone he had given ''Power Of Attorney'' too! We didn't respond in time! How can I slow this wrongful eviction process.? The eviction was for non-payment of rent (the rent that the Owner said we didn't have to pay!)No 3-day notice or anything. Please Help - Time is running out! Cassondra

Re: Tricky Landlord
You need to apply for a stay of execution and a motion to vacate the judgment based on lack of personal jurisdiction.
Re: Tricky Landlord
After you have been served eviction papers, it is very difficult to slow down the process. You would have to apply for a stay of execution, and there are time deadlines that need to be met.
