Legal Question in Landlord & Tenant Law in California
I have having trouble with noisy neighbors that my landlord will not do anything about. I have lived here for 30 years and there was always wall-to-wall carpeting above me until the new tenants pulled it up. They play loud music, up all night drunk or high and using bad language - all of which I can hear.
What can I do about this? My landlord says he can't do anything and that I should call the Police if I don't like it. I have done this twice but they have never shoen up.

Your landlord has an obligation to take steps to allow you to peacefully enjoy your apartment. The problem you face, is where is the line drawn between ordinary noise that comes with living below another apartment, and excessive noise that the landlord must deal with. The landlord is wrong that he can do nothing - he has an affirmative obligation to deal with residents who are interfering with other tenant's rights. Again, the issue is how much do you have to put up with. I would suggest that you put in writing to the landlord your concerns. If they do not respond and resolve, then contact a local attorney to discuss your options further.
