Legal Question in Landlord & Tenant Law in California

umnlawful detainer

I received a courtesy notice from the court that an unlawful detainer had been filed on may 21,2008 but never received any kind on summons [or] any paper asking for a response from me.does this mean that I CAN FILE A MOTION TO QUASH ON THE LANDLORD?

Re: umnlawful detainer

Check the court file and find out if the case is still active. Some courts have a very short deadline regarding service of unlawful detainer actions. If it is still active then you may want to contact the landlord's attorney about whether he claims that the summons and complaint has been served. If so, find out when and on whom, as well as any other details he'll share with you, and then file your motion to quash the service, since it appears from your comments that service didn't occur.
