Legal Question in Landlord & Tenant Law in California
Uninvited guest stays for 13 years
My mother-in-law has had a friend of a cousin staying in her home for 13 years. She seems to like having him there and he does ''help out'' around the place. To our knowledge he has paid rent very sporatically. She has no wills or trusts in place (family doesn't believe in them) My primary concern is that if something should happen to her, dies or moves to a hospital facility, what will we have to do to get him out of the home? My husband is the only living relative.

If you're in California you only have to serve a 30 day notice to have the lodger move out. If he/she does not move out in 30 days, you can have the police remove him/her for trespassing. Good luck.
