Legal Question in Landlord & Tenant Law in California

Unlawful Detainer

Body Shop was evicted. Landlord told me I would not have to actually move out but just change the name of my business and take the old name out of the window, because of this, I didn't worry about actually moving. I signed over my rights to my spray booth for payment. This booth is worth over $30,000 which is more than what I owed. This info is stipulated in the judgement against me. On the eviction notice it states that I have thirty days to retrieve the property left over inside the building @ a storage rate of $116 a day. I've been trying to get in to pack up my things but the landlord now tells me that nothing in there belongs to me anymore. He faxed to me what he calls a copy of the final judgement from the court but the one he faxed says the court awards him all of my assets. This is not true. When I went to confront him about this, I could not find him but in fact found many of my things in the dumpster. He had thrown away all of my customer invoices, receipts, stereo amps that belonged to my customers, a car stereo, clothes, all of my office supplies & I also found my office safe in the trash. This safe had been broken into and the only cash I had to my name ($2500) was taken from it. What can I do?

Re: Unlawful Detainer

Your statement is extremely unclear, as to facts. What, and who, is "body shop"? Sounds like you were evicted, and I have no idea what the "spray booth" is, or was. Then you get into a judgment. Sounds like you didn't answer one or more lawsuits, which tell you very clearly what will happen if you don't respond. I have a feeling you let a lot of time go by between being sued and writing to law guru. If you give me more facts, hopefully in chronological order, I may be able to give you more advice, but it sounds like you ignored legal actions and have little recourse at this time. Without more information, I cannot advise you on what to do. And if you ignored legal proceedings, as I surmise you did, there is very little you can do.
