Unlawful detainer

My neighbor, behind on his rent, failed to pay on a 3-day pay rent or quit/30 day notice. He was then served with an Unlawful Detainer.

How many days does he have to respond to the Unlawful Detainer?

We understand it is 5 days in California. But does that include weekends and holidays?

He was served on a Thursday.

How many days does he have to respond?

Five CALENDAR days....start counting at midnight of the day of service.

In neighbor's case, Friday is day #1, then Saturday, Sunday, Monday, and Tuesday is day number 5.

Therefore, his "answer" must be received and time stamped at the county clerk's office before the close of business Tuesday.
