unlawful detainer

have rented home 3yrs owner is tearing down house for new got husband sign 60day moveout up 10/7 cant find sutible housing have 3 kids set in school pd less rent for area cuz of rebuild no rental agreement.no receipts only verbal comunications can we plead hardship and the day we didnt move was verbally herassed all wkend please help!

I am very sorry, however, your post really doesn't make any sense. If you had no rental agreement, the landlord can give you a sixty day notice without any reason, and you have no right to hold-over. Unfortunately, while a lot of laws in California do protect tenants, without a lease, your right to remain in the property is subject to a pretty short notice. You have few options - you can not move, and he will evict you. Once you have an eviction on your credit report, you will find that renting an apartment is going to be even more difficult. Filing bankruptcy is not really going to help you much as it will only buy you a short time extension. At this point, you need to figure out how quickly you can move.
