Legal Question in Landlord & Tenant Law in California
unlawful detainer
I served my room mate a ''30 Day Notice to Quit'' last month. He says he will NOT move. What is an ''unlawful detainer'' and how and when and by whom is it served to the room-mate?

Re: unlawful detainer
An unlawful detainer is an eviction action. It cannot be served by you. Our office handles unlawful detainer actions. Please call if you have any questions.

An unlawful detainer is the legal system's term for eviction.
You need to file it in Superior Court, and have an adult (other than you) serve it on your roommate.
I am enclosing information from the California courts regarding this area of law.http://www.courtinfo.ca.gov/selfhelp/other/landtenqa-ten.htm
