Legal Question in Landlord & Tenant Law in California

water turn off

I live in a duplex and the neighbors are being evicted. we have the same meter for our water and the landlord pays for the water. the shut off valve is in my garage and I want to know if I can turn it off to fix a leak and not get in trouble with the neighbors. because it would shut off their water as well, but as they are being evicted and haven't paid rent in months I want to be sure that's o.k. I need the leak fixed in my house and there is no way to turn off just my side of the duplex.

Re: water turn off

Have the landlord give them a written 24 hour notice of your intention to turn the water off to make the repair. Work with the neighbor to make the repair period as non-intrusive as possible for both of you.

Re: water turn off

I agree with Attorney Moerbeek, however, if you are also a tenant in the building, then you are not the one who should be repairing the leak, nor shutting off the water. The landlord is responsible for doing so, and giving the proper notices to all tenants. Even if they are being evicted, it doesn't take away their right to lawful notice. If you are just being a nice guy and repairing the leak yourself (rather than bug the landlord), then I would talk to the neighbor who is being evicted, find out when it would be okay to turn the water off, and work with them.
