Legal Question in Landlord & Tenant Law in California
Witholding of security deposit after eviction judgement
If an eviction judgement is entered against me for nonpayment of rent
only, is my landlord entitled to keep my security deposit after I have
already paid any unpaid rent and lawyer/court fees as per the
judgement?

Re: Witholding of security deposit after eviction judgement
You should be able to recover the security deposit (assuming that there was no damage to the property). We need to review your written agreement which should include the deposit as well as the move out statement and other documents and lawsuits that you have as well as proof of payment.
