Legal Question in Landlord & Tenant Law in California
writ against former tenant
the old management company is attempting to enforce a writ of possession on property they no longer manage. The property has a new owner. The old management company filed an unlawful detainer in an attempt to evict a tenant of 14 years in order to file a claim with HACLA. The property was sold to a new owner. The new owner has given the 14 year tenant another unit. Isn't it illegal for the old management to evict a tenant from another owner's property?

Re: writ against former tenant
The new owner succeeds to the rights of the old owner. It's a matter of form over substance, and you'd spend a lot of money and time challenging the writ, and probably would not be successful since the court could amend the judgment upon request to conform to the new facts. Good luck to you.
