Legal Question in Landlord & Tenant Law in California
Wrongly charged after leaving apartment.
After 4 years & 8 months of apartment tenancy, I had my tenancy terminated & given 30 days to move out. The last day of tenacy was August 20, 2006. The landlord told me that I would get my deposit back 21 days after I gave her the ''keys''. My family moved our possesions on time & cleaned the apartment. On the afternoon of August 20th, I dropped the apartment keys into the landlord's drop box that is usually used for payments (the landlord takes Sunday & Monday off). On August 21st, we remembered that we had other keys to give to the landlord; mailbox & laundry room keys. The landlord answered their door on 21st & accepted the extra keys. I just received what was left of the security deposit. Here are my concerns:
1. We were charged an extra day (21st) of rent against our security deposit even though the notice said 20th was the last day. I think this is because I provided the mailbox & laundryroom keys on the 21st. Is this legal?
2. When we moved in (12-01-01) there was some metal wire shelving in the closets that we thought were supposed to be there and therefore didn't document it. After leaving, we were charged for the removing of the shelving. Is this legal? How are people supposed to know how to document such things?

Re: Wrongly charged after leaving apartment.
You surrendered possession of the apartment when you turned over the keys to the front door.
