Legal Question in Legal Ethics in California

Auto-body Business Question

I recently bought a body kit for my car. I took it to a autobody business and he said he would have it done in a week. He waited 6 months to start on it. He has had my car for 7 weeks now and still hasn't installed the items he had promised. I paid him up front and signed a contract for the work to be done and installed by the end of February. It is now May 02 and the work is still not even completed. Every day he promises that it will be done the next day. It has become a huge inconvenience, i find it hard to get to work, school, and has wreaked havoc on my social life. What can i do to this guy legally?

Re: Auto-body Business Question

in a nutshell, from the facts given so far, you can sue this person for breach of contract for failing to perform within the stipulated or reasonable time period based on the terms of your agreement. you would be entitled to recovery of all of your out of pocket expenses that this person has cost you beyond a reasonable or stipulated time period in which he "promised" to perform within. further, you would be entitled to recovery of any other damages that it may cost you to have your car taken to a new shop to have its servicing completed there in a timely manner. if you would like further legal assistance and/or representation in this matter, email my Law Firm directly today with more details and how you might want to proceed.
