Legal Question in Legal Ethics in California

Borrowed camera gets broken.

I had a person borrow my video camera and they returned it damaged. I have filed a small claims. But I would like to know the law that says they are liable to fix it. Hope there is one.

Re: Borrowed camera gets broken.

If the damage resulted from the other person's negligence, that's all you need. Of course, if the camera just suddenly stopped working for no reason, then more than likely the other person's not liable. For instance, if the battery died, that would be your problem. If, on the other hand, he/she jammed a pencil point in the shutter, then he/she is liable. Make sure to bring an estimate or invoice (and evidence of your payment, if any) from a reputable camera shop of the cost of repair or replacement.
