Legal Question in Legal Ethics in California

Conservator / Guardianship #2

my son has large estate due to an accident when he was young, the public guardian is in charge. My son will be 21 tomorrow and they have not tried to help out by paying any rent or utilities, they only give him 300.00 per year for clothes. Because he can only crawl when not i his wheel chair, his pants wear out fast.

Shouldnt they help out more?

I formally requested that the guardians petition the court over 3 years ago, when my son turned 18. I am not allowed to petition the court at all. Matter of fact, the public and private guardian used money from my son's account for legal representation when the quardianship changed to conservatorship and I was not allowed on penny for legal help. I am the sole are provider for over 20 years now. How can I get help for my son.

Re: Conservator / Guardianship #2

This is very complex, because there are several different complicating issues..

First, though, be aware that guardianships end at 18, and then it would be changed to conservatorship. I am puzzled by the fact that the courts took his care away from you, indicating there is something in your background rendering you incapable to care for him,

Without knowing more facts, I cannot answer.

At this point you need to seek out a local attorney who specializes in estates, and conservatorships. If you do not know of any, go to the State Bar, either in your phone book, or on the internet, and look up the Lawyer Referral Service.

I regret that I cannot give you more help.
