Legal Question in Legal Ethics in California
I had a court appointed attorney for childrens court and being such a messy situation, I wasn't too cooperative with the courts and I don't really think my attorney cared if I got my kids back. (It appeared that way because I wasn't following the case plan). This was 02/28/06 and as of today 07/24/09 I have been sober and finished all my classes. I called DCFS for info regarding getting my kids back and they told me to contact my court appointed attorney. I did and told him what I needed and if he was going to file the 388 for me and he told me to **** off and hung up on me. Isn't there a Code of Ethics that's been violated here? If he was going to not help me now that I am sober, why didn't he dump me back when I was obnoxious? Can I complain to someone??

While I have nothing good to say about the DCFS or their "court appointed attorneys," if you waited 3 1/2 years to become sober that isn't going to impress anybody. You could always file a 388 in pro per, or hire a private attorney.
