Legal Question in Legal Ethics in California

No discovery response

I would like some help here. I am a defendant in a litigation matter. i served plaintiff discovery papers for produciton of documents. I waited 35 days but they still had not responded. What can be done next? A motion to compel?

also they want no dealings with me and they don't want to settle out of court (they refused ADR). So i have one last question. They scheduled a calendar date for trial twice the first time i was notified but this second time i wasn't. Who is responsible for failure to notify me this second time? the court or the plaintiff, and can i do anything about this, its next month.

thank you

Re: No discovery response

you have to send them a written demand with an offer to discuss the matter and then file a motion.
