Legal Question in Legal Ethics in California
Duplicate paychecks
Hello, I have been working with a
company for four years and was
given by my employer two duplicate
pay checks and cashed them. A year
later the business owner came to me
and informed me that i should have
questioned the checks and not
cashed them. Therefor i was fired and
my last paycheck was kept to cover
the balance of the duplicate pay
periods. Now he is taking legal action
against me and also trying to stop
me from receiving unemployment.
These checks were given to me by
the wife of the owner which was
authorized to sign and give out the
paychecks. Is it my fault?

Re: Duplicate paychecks
It is your fault.
However, I doubt he will win the law suit, and I would file for unemployment.
Re: Duplicate paychecks
Sounds like the business owner is getting divorced.
Also sounds like this is a side issue, i.e., he wants to fire you and is using this as an excuse.
