Legal Question in Legal Ethics in California

Ending a contract and the back fires

Hello,

I am a graphic designer on my own. I have a client that signed a contract to have me create a web site. She paid me half to start and says she can not pay the other half until Jan 08'. My contact states if i dont hear from her in 30 days anytime during the project, I have a right to close the contract.

Am I safe? What can back fire on me?

I have suggested a deal with her, but she will not respond to my deal. I want to close this and move on. I will give her the uncompleted site files.

Thanks

I think I would need to know more about the precise language of the contract before offering, but to the extent that I understand what I think I understand, I think you're... ok?

But really, the contract needs to be seen. I think.

You really haven't offered enough facts to give you a definite answer.

You would have to read the provisions of the contract carefully, and make sure what you two have signed.

Also, what do you mean by "closing the contract"? Are you thinking of stopping work on the web site, or is your work completed?

I, also, am not sure what you mean by "safe" or "back fire"? Are you asking whether stopping work on the web site can lead to legal problems with your client?

What were the payment arrangements? Is there more work to be done? Has she paid you enough, and is the money enough, for you to complete work, and then wait until January for payment?

Do you anticipate problems being paid in January?

If you wish help from me, please feel free to e-mail, or call, my office and perhaps e-mail, scan, or fax the contract so that I can look at it and advise you better.

Also, help me out with clearer facts.
