Legal Question in Legal Ethics in California

Our HOA attorney attended our monthly board meeting due to conficts within the board of directors. In the open session, many homeowners were under the impression that one of the directors was suing the association. Several homeowners attacked the board member for spending funds on a lawsuit. The attorney allowed homeowners to verbally attack the board member when she knew there was no lawsuit filed. Doesnt the attorney have an ethical obligation to protect the organization? What would the benefit be in making homeowners believe there was a lawsuit when there isnt? The meeting got hostile and the board member who was accused had to leave the meeting in fear.

The HOA attorney is there to represent the organization, but not to run the meeting. The attorney is there to represent the organization, and not necessarily represent an individual board member. You didn't mention what the faux lawsuit was about, but it may not matter. Without more informtion it is hard to give you a more complete answer.
