who should be hold responsible
I was hired recently as a supervisor for Orange County Social Services Agency. Today I found out that one of the people I supervised was carring a tape recorder in his pocket and he recorded our conversations and also my conversations with other staff. He took the tape to my supervisor to create a problem for me and hoping that he would get my job. My supervisor refuses to listen to the tape and ordered him to never bring the recorder on county property again. Should this person be fired? Can County be sued for this person actions, expecially if they do not let him go?

I cannot say whether the person should be fired.
Also, the county could be sued based on your set of facts, but would almost certainly prevail. You can sue anybody...the question is if you could win.
This is a criminal misdemeanor. You could always go to the police, or D.A., but I can almost guaranty you that no charges will be filed.
I agree with the way your supervisor handled this.
