Legal Question in Legal Ethics in California

legal fees include non-reimbursable medical payment?

i was rear-ended in a car accident, which was not my fault. i hired a law firm to handle this case. my car insurance policy includes medical expense coverage with a limit of $5,000.00 (NO EXCESS, NO REIMBURSEMENT). my car insurance company paid this $5,000.00 directly to my doctors, which upset my attorney/negotiator saying that the money was to go into a trust fund. is this $5,000.00 no reimbursement medical payment to my doctors INCLUDED in my attorney's 35% fees?

The answer to your question would be spelled out in your fee agreement with the attorney. It is impossible to answer your question without the benefit of having your fee agreement available to review.

Mr. Starrett is right. There are attorneys who take a fee on this. There are also attorneys who do not take any fee on med pay. You need to look at the fee agreement. This is one of the important considerations before you hire an attorney. You may want to read more about this topic at my blog, www.calpiblog.com
