Legal Question in Legal Ethics in California

Legal Malpractice and State Bar Memberhip

I am attepmting to get reinstated to the State Bar of California. I have several malpractice judgments against me from a previous point in time when I was practicing law - which have been discharged in bankruptcy.

Can the State Bar of California require me to pay off the judgments - contrary to the Bankruptcy Act - in order to be reinstated?

They can, if they want to. The State Bar is not bound by civil or criminal laws, and can set their own rules, when it comes to ethical questions, especially involving "moral turpitude".

Also, were you suspended, or disbarred? If suspended, have you provided all the asked for materials (probably including passing the MPRE) required?

Also, if you have an assigned probation officer, it would behoove you to ask him/her rather than me, of the requirements for reinstatement.

There is a lot more I could tell you, but I have to know the details involving your suspension/disbarment/etc,

Please feel free to e-mail, or call, my office for more advice.

Good luck!
