Legal Question in Legal Ethics in California

how to make a complaint

I have lost confidence in the attorney handling my divorce. Which is the better strategy for making a complaint against him while still keeping him as my attorney; complain to the local bar association or to a partner in his firm? I paid a fixed fee for his services and cannot afford another attorney.

Re: how to make a complaint

If you have lost confidence in your attorney, cotinuing to use that attorney is not a particularly good idea without talking about these issues. Complaining about your attorney while he or she is still representing you is an even worse idea. Your attorney may decide to withdraw from the case.

If you have lost confidence in your attorney, you need to have an open and honest discussion about this issue. It could be that the attorney's workload was simply to large to respond to a recent question you may have had. It also might be possible to get a partial refund of your retainer so you can find another attorney.
