Legal Question in Legal Ethics in California

Thank you for the oppertunity to ask! I have a person that I allowed to remain at my home for some months and pay me some rent. there was no contract.

I want him to leave and he says he will --maybe by the end of the month. He is of course continuing to use the facilities but is not paying any rent.

How do I get him out, do I have to do a UD in Calif?

He is a tenant so you must follow the UD procedures. The easier way to get rid of him is to bribe him with a money payment.

Yes, you would have to do an unlawful detainer, to get him out. A lease is not necessary to create a tenancy, rather it is acceptance by the landlord of rent that creates a tenancy. He appears to be on a month to month tenancy.
