Legal Question in Legal Ethics in California

My question is the county d.a. has been appointed as a judge and he now set in court as the judge in his former offices case against me. is this legal for him to do. i don't stand a chance. please help answer this question thank you

If he was the prosecutor on your case, and is now the judge, then he should recuse himself. If he will not do that, then your attorney should be filing a motion to disqualify him.
