Sister state law practice

If a lawyer from one state moves to calif. and takes a depositions for firm( case has gone to discovery)prior to his adimittance to the state bar of ca. is it unautorized practice of law?

it may or may not be illegal

If he is in California taking a deposition for a case filed in another state where he is licensed then it is legal for him to do that. If he is taking a deposition in a California case it is illegal unless he has the permission from the California court to do it. Sometimes a client has an out of state lawyer and wishes that lawyer to handle the case or associate in on it. There is a procedure where the lawyer can petition the court to allow him to handle a particular case. To find out for sure you need to check the court file in the case.
