Legal Question in Legal Ethics in California
Hello, I got a tattoo done on halloween at a tattoo shop on Melrose Avenue.
I did sign a paper that stated that I understood the tattoo would change my appearance, and that I had been given instruction on how to care for it properly, etc..
Once it healed, I realized the guy had done a very bad job. The lines are terrible, crooked, and vary in tone (it's a black letters tattoo) and also some letters are bolder than others.
I went back to show him and he acted like I was being 'a perfectionist' and told me he did not see anything wrong with the tattoo, that he didn't know what I was talking about, but that if I wanted to get it 'fixed' that I could go some day during the week for him to fix it.
His whole attitude and the very bad job he had previously done, most definitely did not give me a sense of safety to let this guy 'try to fix' the job he had done. So I left and haven't been back since.
I went to 3 different tattoo shops and asked their opinion as professionals, on the tattoo I got.
The three tattoo artists at 3 different shops, said that the tattoo was done terribly and advised me not to let the guy 'fix it', since it was going to take for the letters to be way bigger and bolder than I wanted, and because obviously, this guy had no clue of what he was doing in the first place.
One of the tattoo artists told me that if I decided to sue the shop, he would definitely go and testify as a professional, that the job was poorly done.
I live in Downtown L.A. and like I said, the shop is located on Melrose.
I have never sued anyone before and I really did not want to sue this guy but I feel like he did a poor job not only as a tattoo artist but was rude to me afterwards, and I can't believe that shop is still open and charging 80 dls an hour!
What I want is for him to pay for the removal of the tattoo and if possible, to pay for the price of getting the tattoo done right by another artist...
Do I have a case here?
I don't have any proof other than the guy's business card with all his information and I guess pictures of the tattoo place, uploaded to FB a few minutes before I got the tattoo done, but no actual pictures of the guy tattooing me.
They have my paperwork signed at the shop, I suppose...
I would appreciate any legal advice as to what to do and if I have a case or if I'm better off paying for laser removal myself.

The key to your situation is whether or not the other tatoo artist really is willing to testify for you. He or she would need to be willing to testify that the only way to deal with it is to remove it and redo it. If you have solid evidence of that, you have a good case.
