Is the University responsible?

This past Monday we had a terrible windstrom of winds up to 80mph. During this windstrom a light pole in the parking lot fell on a university employees vehicle and caused damaged of at least $5000. THis employee now has no vehicle to drive to work. THis occurred during working hours. Is the university responsible for paying for the damages?

The owner could make a government tort claim with the university for repair (if it's a state university). However, unless the University failed to properly bolt the pole in place, if it's an "act of God" (the law's words, not mine) one typically cannot be held liable.

I agree with Mr. Cohen. This is probably an "act of God" and not the responsibility of the university. If the university knew or should have known the pole would fall in a windstorm, there may be a claim, but it is doubtful.
