Legal Question in Legal Ethics in California
After almost a year, my wife's lawyers say they would not take to court her worker's compensation claim and would only work on a settlement. My question, is the ethically or legally correct, if she wants to pursue a court settlement as opposed to out of court? Can he refuse and make us go to another lawyer at this late stage?

Your question does not make sense. There is no difference between a settlement reached in a court settlement conference and an out of court settlement. A settlement is a settlement.

Worker's compensation claims are not tried in our courts, except for writ jurisdiction. Jurisdiction over worker's compensation claims reside with the Worker's Compensation Appeals Board.
