Legal Question in Legal Malpractice in California
My divorce atty has done nothing for five years. He has only been to court 4 times before now. My wife got a restraining order so I have never got my personal belongings. I asked for spousal support and the judge gave it to my wife of 4 years because my atty never shows up and wastes his time. my atty told me not to worry that he would get it lifted. he never did this was 4 yrs ago. now my case is set for trial and my aty said to let everything go. this woman lives in my house that she sold me and she has lied. she wants me to lift the lis pendens but since i won't she said she would drop the restraining order if i did. well that doesn't make sense if she's afraid of me; anyways my atty said that he wants out and he said i have a good argument but he wasn't going to do it for what i am paying him for. can i sue for malpractice.
