Legal Question in Legal Malpractice in California
I got a judgment against a lawyer. Thank God, she has a malpractice insurance with deductible. Am I paid in full by the insurer or the insured has to pay the deductible to me? She appears to be broke.

The insurer does not pay the deductible. That is what a deductible means. That amount is deducted from the amount the insurance company pays. The insured has to pay the deductible.

I disagree with Mr.McCormick. You should be paid in full by the insurer. The deductible issue is between the lawyer and the insurance company, and is usually paid upfront when your claim was filed.
