Legal Question in Legal Malpractice in California

My Lawyer Cost Me My Suit By Errors

I was informed last week by an attornry who reviewed my former lawyer's appeal in connection with my Long term Disability Claim, that he argued it and appealed it all wrong, consequently costing me my claim, the above lawyer who reviewed my file informed me in no uncertain terms that my former lawyer ''screwed it up''. What recourse do I have against my former lawyer for his negligence in connection with the above? Also how do I proceed in this direction?

Any help with the above is greatly appreciated in advance.

Re: My Lawyer Cost Me My Suit By Errors

Sorry to hear about your experience. You should check with an attorney who specializes in the area that your former attorney practices and who also takes legal malpractice cases. Most likely, that lawyer will want to retain an expert to examine the entire file of the previous lawyer. You will have to show not that you "might" have done better but positively would have done better in the underlying claim but for the attorney's negligence. You have one year from the date of the operative act of the former attorney to file a civil complaint against the attorney. Good luck!
