Legal Question in Legal Malpractice in California
Lawyer not present for court dates
We hired an attorney to represent us on a personal injury claim against our landlord. The landlord shut our water off to our unit, their was a fire, and my husband was injured, in addition to us losing a majority of our belongings. We were all the way to the steps of a mediation hearing and our attorney did not show up for the hearing date. We did not find out until almost 3 months after, at which time he said he just could not make it. We terminated his representation, and would now like to refile the case, we are within the statute of limitations time. We also have contacted the CA Bar association to file a complaint, we also would like to seek damages for malpractice from the attorney as we had a very strong case against the defendants. Where is the best venue to file against this attorney ?

You left out some important information such as, what happened to your case? It might be possible to reopen the case. The best venue would be where your home was. Please e-mail me with your case number and I'll see what I can figure out for you.
