Legal Question in Legal Malpractice in California

Legal malpractice

cAN i SUE MY FORMER LAWYER FOR LEGAL MALPRACTICE AND UNSUBSTANTIATED FINANCIAL CHARGES? HE LEFT MY CASE AFTER 1 1/2YRS. CUTTING HIS LOSSES ONLY TO RETURN TO THE CASE 1MO. BEFORE TRIAL AFTER I HAD IT ALL READY. HE INCLUDED ALL PRIOR BILLS IN THE TOTAL BILLS, PLUS HE PAID AN EXPERT WHO IN A VIDEO DEPOSITION SAID HE WOULD UNDER NO SURCOMSTANCES ACCEPT ANY MONEY FROM ME, AND THE LAWYER WASN'T TO PAY HIM TILL I SPOKE WITH HIM AND AGREED TO RELEASE OF FUNDS. HOWEVER, HE DID PAY HIM AND SENT ME A LETTER TELLING ME HE WAS NO LONGER REPRESENTING ME YET AGAIN. TO TOP THINGS OFF I BELIEVE HE MAY HAVE BEEN PAID OFF BY THE OPOSING SIDE, SINCE WE HAD A JURY AWARD, BUT WHEN IT CAME TIME TO GET THE MONEY HE INSISTED I HAD TO SIGN THESE PAPERS THAT I DIDN'T UNDERSTAND, TELLING ME NOT TO WORRY THE JURY AWARD WAS PUBLIC RECORD AND THAT WON'T GO AWAY. WELL IT WENT AWAY AND NO SHOES THAT IT WAS DISMISSED WITH PREJUDICE. ALSO THE TRIAL EXHIBITS HELD BY COURTS HAVE SINCE BEEN DISTROYED SINCE HE NEVER SENT IN THE REMOVAL AS COUNCEL PAPERWORK, MEANING THE NOTICES WENT TO HIM AND NOT ME. HE HAS REFUSED MY CALLS, AND HAS SINCE BEEN UNREACHABLE.

Re: Legal malpractice

You may have a claim for malpractice and also for any money that he received. Everything depends on the facts of what happened in the case and if he received any money. I recommend a strong letter from an attorney inquiring as to these details. Please call me if you have any questions.
