Legal Question in Legal Malpractice in California
We were living in apartment complexes that were making us ill, so we decided to do something about it. We hired a lawyer; however, he quickly dismissed our case and said that he would get us three months rent free while we looked for a place. After the three months we received a letter from the sheriff saying that we had to get out and so we did. Fastforward five months later and I receive a telephone call from a debt collector saying that we owe 1600 dollars from the apartment complexes. Here's the thing now we decided to call our lawyer to tell him about the debt that they are trying to collect and why they're charging us. He said tell them that I want to see proof of this alleged debt and to send it to him, but when we asked him how our case went he refuses to give us our case file so that we can send it to the debt collectors and he refuses to talk to us! Can someone anyone tell us what our next step should be???

Send the attorney a written letter certified mail RRR demanding your file. Follow up with the state bar.
