Legal Question in Legal Malpractice in California
My wife and I hired an attorney to represent our home in a modification. The fees were to be 1550.00 per month for 4 months + 365.00 to file a lawsuit due to the prepritory nature of the loan. After the first month, the fee for the suit went up to 875.00. We asked for a documentation of what the fees were going for and never recieved that information. Upon our third meeting, we were told that the fees for the suit now would be $1500.00 on top of the monthly fees. Again, we asked that the fees be documented and again, never received documentation. My last contact with the J.D working on our case stated now that the law suit filing fees were $2575.00. I contact the principal attorney to discuss my outrage. We set an appointment to meet, and she never showed up to the meeting. Since then she has failed all attempts to meet with us and when I asked for the Forensics report that one of the payments were to applied to, they could not generate that report to send to us.
We received a call from Wachovia / Wells stating that an employee contacted the bank to let them know their firm no longer represented our case.
I have called the firm to let them know I will be picking up my files and that I wanted the forensics report or the $1500.00 fee. We have a signed contract for servies rendered.
