Legal Question in Mediation in California
about an accident
if someone is tailgating and going too fast, and you are on a curved area where you have to slow down and you need to slow down for traffic, who is to be at fault?

Tailgating is improper and dangerous. Also, traffic should flow at a speed that is both legal and proper for the road and traffic conditions. It seems to me that the tailgating driver would be at fault.
