Legal Question in Mediation in California
poor workmanship
I had a contractor(Owner's name is Brian) build an overhang over my patio. In June, I noticed water leaking from the bottom of the rain gutter. The water seemed to be coming from the point where the gutter is attached to the roof. I then contacted Brian and told him of the leak as well as the fact that I never received a building permit even though it is specifically documented on the contract.
Brain came out and applied some additional caulking to the seams of the roof. The problem persisted. I contacted Brian again and he came out and put more caulking on the seams. Again, the problem did not go away. During rainy season, the leaking started to appear in several places, again coming from between the roof section and the gutter. Brain told me he would come out and scrape the original caulking off and redo the entire roof. That was in March, 2004.
I have called his cell phone (925) 584-7162 and left messages at least a dozen times. I can substantiate the calls by pulling my cell phone bills. At this time, Brian does not respond to my calls or emails.
What can I do next ?

Call the Contractor's State License Board for help, or file a complaint online at http://www.cslb.ca.gov/consumers/infocomplaint.asp
Brian's contractor's license no. should be on the contract, on his truck and on his business card. If not, you can look it up online on the same web site. If he isn't licensed, the CSLB will still help you.
