6 Week Baby Dehydrated in Hospital

When my baby was 6 wks, we took her to ER for vomitting/Diarrhea. She was admitted because they felt that she was dehydrating since she was not keeping any fluids in. Several tests, no diganosis was found, but she was still hospitalized. 3rd day, her IV fell out, but since she had started to Breastfeed again and was no longer vomitting (Still had diarrhea) they did not reinsert her IV. I was instructed to set aside all diapers that had stool in them which was at least once an hour, but the nurses were just letting them pile up in the room and not weighing them as intstructed. During that night, my daughter still did not look right, was crying and eyes sunken in her head. After wondering the halls and complaining to the nursers, they sent in a doctor who said they cannot give her anything to help her pain. I stil felt there was something wrong with my baby since she did not look well. Once the shift change took place in the morning, the new nurses came in and I compalined to them and they seeked a doctor, once the docotor came in the room, they had me hand over my baby and minutes later she coded. There are more detasil beyond this in terms of issues she has not faced, but with this info so far, do I have a malpractice case?

There are so many different variables that go into a medical malpractice case that no honest attorney should tell you that you have a great case right from the start. An attorney may be able to take your case, but unless that attorney is also a medical doctor who has knowledge in the relevant field, then that attorney can not tell you how strong of a case you have until a medical expert reviews your file. Just make sure you act quick, i.e. like the next few days, because you have a short amount of time to bring cases before the court, otherwise your case will be time-barred. It is ONE year for a medical malpractice action. Act quick and call a lawyer.

I am very sorry to hear about what happened to you and your baby. Medical malpractice cases are complicated. In that, for the most part an expert review is needed. What I can see from your post however, is the fact that the doctor's orders may not have been followed by the nursing staff.
