Legal Question in Medical Malpractice in California

c4-5 herniated disc

hi. i didnt injure myself it just happened. on 12/24/03 i went to the L.A.

county hospital for severe pain,

weakness,numbness,right shoulder pain.test were given.but no mri.

doctor said dont know whats wrong.on2/13/04 i was taken back to the same hospital,same clinic this time i was admited into the hospital.a mri was taken on2/18/04 and found cervical spondylotic myelopathy secondary to c4-5:primary procedure c5 anterior cervical diskectomy with anterior fusion and arthrodesis with microscopic intraoperative.this was done on 5/3/04.i had complain to the doctor who had treated me after my surgery.i got my own mri on 11/09/07 and show c3-4 disc levels

reveals a diffuse disc bulge measuring 2-3 mm there is a displacement of the posterior longitudinal ligament.the neural formina are patent bilaterally.the facets joints are normal.the doctor on 11/27/07 last appointment .said we know about the damage .i ask are you going to take it.doctor said no.it wasnt warrantedt to operate on it. now the damage may permente now.can you help..thanks

You need to consult an attorney experienced in medical malpractice. He or she will obtain your medical records and have them reviewed by an expert who can provide an opinion on whether or not the standard of care was breached.

In addition to what my colleagues suggest, it would behoove you to find a spine specialist who could give you a definitive opinion about what relief is available to you and do all you can to get healthy.

Med mal requires expert testimony and support. If you take the case to a med mal lawyer he or she can get it reviewed. But, the doctors charge for the review. $400 - $600 per hour.
