how do you count for un earned income from a job if you cant go back to work from med mal lawsuits?

What I think you mean is how do you prove loss of future earning capacity -- which is an element of damages in a med mal lawsuit. Usually the lawyer who handles the med mal case would retain an expert witness in economics and/or vocational rehabilitation.
