Legal Question in Medical Malpractice in California

Dental procedur

I have constant pain that wont go away that was caused by a procedure that was not needed at that time. How do i go about bringing action against the dentist/group?

You need to speak with a lawyer who handles personal injury and/or medical malpractice cases.

The limited facts you state doesn't make this an automatic case.

You need to show that the procedure either wasn't necessary, or was done with much less skill that the dentist should have shown.

You should have the case evaluated by an attorney that does a lot of medical/dental malpractice. If you sue them yourself, you will likely lose since you will not be prepared with the evidence you need to prevail. You must have expert testimony that states that the dentist was professionally negligent AND that the negigence was a significant cause of your injury. You will also need expert testimony to prove what if any treatment will be required to fix or deal with the problem, how long it will last and what that will cost.

Without expert testimony, you lose.
