Legal Question in Medical Malpractice in California

Diagnosed as hyperventilating discharged twice later find out it was a stroke.

diagnosed has hyperventilating discharged twice a week later it was a stroke. He now has right side paralysis and brain damage/dementia. He has severe memory deficits. He lost his home, his girlfriend, friends, his driving priledges, his freedom/independence. He lives in a home. He's only 53 years old. I need help. This is not right that a doctor who is suppose to make sure you get well, but instead his ego gets in the way and someone like the patient has to pay. He didn't want to make the diagnoses as a possible stroke when all the signs were there. Because he could not breath--the patient- for three or so minutes, when he was able to, lhe would be gasping for air. When the doctor walked in he immediately diagnosed it has hyperventilating. There's a lot more to this saga. thank you.

Medical negligence is a very difficult action to prove. It is not simply the fact that there was a very bad result or very bad damages but whether the doctor used the same degree of skill that most others would have in the same circumstances. It will be necessary to have another doctor review the records and provide you an opinion as to whether there was malpractice. You must file your lawsuit within one year of the date of the claimed malpractice. This is an expensive investigation but unless one of his subsequent doctors has already told you the first doctor made an error and was negligent this is necessary.
