Legal Question in Medical Malpractice in California

Please help

My father had 2 previous heart attacks, he had diabetes, and he was in dialisis. On March 2008, he was interned in the hospital because he got gangrene on his foot, he suffered another heart attack, and died.

MY question is, if they were monitoring his heart, which they werent, they whould of known when he got his attack, but they found half an hour later, that no oxygen went to his, brain and he died. SO, because of his history, werent they suppose to monitor his heart

Maybe yes, but your father was too sick to make causation a likely element of proof. In order to recover for negligence, one must prove both negligence and that the negligent conduct caused his death.

Not the kind of case I would take.
