Legal Question in Medical Malpractice in California
what do i do
My husband was injured on the job 10/99 and 5/2000. He opened a workers comp claim. He was seen by a few doctors. He was crushed by a car at work. his injuries were neck,upper,lower,leg and shoulder pain. He complained of headaches all the time. One of his doctors prescribed vicoden. My husband died in dec. We have a 8 yr old who is going through it. The cause of death from the autopsy was spontaneous intercerebral hemmorrage and essiential hypertension. I recently found out that vicoden should not be prescribed to paitents with high blood pressur. My husband was not aware of this medical condition. Why wasn't any of his doctors? Getting your blood pressure checked is equivelent to getting your tempature taken these day. Should I follow up on this? Aside from this I also have recently found out his physical therapist is the attorneys secratary's daughter and she was not seeing my husband but billing the insurance company.

You and your son may well have a viable wrongful death case. You will need to have a qualified lawyer obtain and review all of his medical records since his industrial injury. If there is a viable case it will be handled on a contingency basis meaning all legal fees come only from amounts recovered. Time is of the essence. You can lose your rights by sitting on your rights.
