Legal Question in Medical Malpractice in California

I went to Kaiser and got a positive preg test but when I got sonogram the baby was not in sight in uterus. Doc recomended a DNC procedure. The DNC procedure was done that THurs. They were to send the matter to lab testing to see if pregnancy was in fact extracted. I was supposed to here from them by next day and didnt. I didnt hear from them that saturday or sunday either. THat sunday I went into emergency for an ectopic preg, my tube had erupted. My left ovary and tube were taken. I was told by doctor that did DNC that any future pregnancy would be risky because she thinned my uterus too much in one area. There was not even any preganacy matter found in the uterus. I am experiencing a lot of complications with my "recovery" the doctor says its just gas but my body says its more. How would I go about finding out if what is happening to me is due to a mistake made by doctors? And my husband and I plan on having another child, the fact that she thinned my uterus out too much during a DNC procedure (unecessarily) makes it risky when we are ready to have our next child. Do mistakes like this make a lawsuit?

You may have a medical malpractice case, however without knowing more information and additional facts, it is difficult to state for certain. It is important to examine whether the hospital and your doctor acted below the standard in the community. We have medical experts who will be able to look at your medical records and determine if that is the case from a medical point of view. Furthermore, please note that Kaiser and physicians that are associated with Kaiser are usually protected by an arbitration clause. This means that you may not be able to proceed to a lawsuit, but rather go through the process of arbitration. My office will be happy to discuss additional facts with you.
