Legal Question in Medical Malpractice in California

I went in for a lumbar joint injection in April. Two weeks later I returned to the dr. for post follow up and complained of a new pain that was like sciatica. The dr. told me to take ibuprophin for two weeks and come back if it got worse. During those two weeks, we had a trip to Europe, and my pain got significantly worse during that time. When I returned to the US, I went back to the dr. and it was discovered that I had an Staph infection in my spine. It resulted in emergency surgery, and significant nerve damage down my left leg. While the nerve is healing, I still have pain, am on pain killers daily, but the worst part is that my back hurts worse than when I first went in for the injection.

Question is, do I have a case against my doctor or the surgery center for giving me the infection in the first place and not diagnosing it soon enough?
