Legal Question in Medical Malpractice in California

medical malpractice/husbands death

My husband was addicted to pain medication and went to a Rehab. When he came back after staying in Rehab., he went back to the doctor and the doctor prescribed him more pain medication, from what I understand it was a stronger pain medication. I am still waiting for Coroner report. My husband accidently overdosed and I found him dead in bed the next day. From what I have told you, would I have a case of malpractice? Pls. advise. thanks

You need to consult a medical malpractice attorney, who will obtain a copy of your husband's medical and rehab records and have them reviewed by a medical expert. Only the medical expert can establish that there was an actionable breach of the standard of care. On its face, the case looks bad for the doctor, but I don't know the whole story, and I'm suspecting you don't either.
