Legal Question in Medical Malpractice in California

Medical Misconduct and assualt

Can I sue the hospital that caused my mom to be hospitalized after a nurse verbally assaulted her and my mom has heart problems, high blood pressure, and diabetic? The nurse understood that my mom did not speak english and when my mom didn't understand what the nurse was saying with the exception of the nurse calling my mom a stupid idiot causing my mom to get angry and caused her blood pressure to go sky high and cause damage to her heart and be hospitalized for a week. Now my mom is scared to go to hospitals or doctors, her blood pressure is constantly higher than normal and she can't sleep and feels chest pain all the time. We need help.

Can you sue? Yes! Can you win? Almost certainly, no!

I could write for an hour on this, but Mom isn't going to win.

Yes. But, proving causation will may be a problem. YOu also can sue for elder abuse. Problem is you will need to finance the costs for medical experts, and I assume you have witnesses to the event since I doubt the medical record will describe what you describe.
